What Myanmar law says

Common Myanmar practice is to settle final pay within 7 days of the last working day. Some sources reference 30 days under specific contracts. The conservative — and audit-safe — standard is 7 days. Late settlement is a Payment of Wages Law violation. The employee can complain to the township labour office within ~6 months under the Settlement of Labour Disputes Law.

Documentation requirements

  • Bank-transfer receipt or signed cash-receipt entry.
  • PIT working papers and remittance evidence.

Edge cases

  • Holiday cluster (Thingyan, year-end) — pay before the cluster; do not delay.
  • Disputed components — pay undisputed parts on time; defer the disputed amount with consent or arbitration.
  • Bank-system delay — not a defence; arrange alternate payment.
  • Out-of-country employee — bank transfer to local account; FX conversion at CBM rate.
  • Death-in-service — pay to nominee promptly; same 7-day target.
  • Probation termination — 7 days from last day; same standard applies.

Employer takeaway

Settle final pay within 7 days of the employee's last working day. Components: wages + leave encashment + notice pay + severance + contractual gratuity, less PIT, SSB, and agreed offsets. Cannot be withheld pending exit clearance. Pay PIT to IRD by the 15th of the following month, file annual PIT by 30 June, and retain records 7 years. Late settlement is a violation reportable within 6 months.

Common payroll mistakes

  • Treating "next payroll cycle" as the deadline — the 7-day window is independent.
  • Holding the entire settlement when only one component is disputed.
  • Withholding pending exit clearance (see withhold for exit clearance).
  • Missing PAYE remittance on the lump sum.
  • Skipping the signed settlement statement (see final settlement calculation).
